PHOTO BOOTH TERMS & CONDITIONS By using the PhotoBoothGo website and/or placing an order ("Order"), you ("Client") agree to the following terms and conditions ("Terms"). These Terms outline the responsibilities and obligations of both parties to ensure a successful event. Your acceptance of these Terms is demonstrated by completing an Order. We may update these Terms at any time, and the latest version will be available at [PhotoBoothGo.com/terms]. 1.⁠ ⁠PAYMENTS & RESERVATION POLICY •⁠ ⁠Full payment is required at the time of booking. Orders are confirmed only after payment is received. •⁠ ⁠Accepted payment methods: All major credit cards & Venmo (processed via Stripe). •⁠ ⁠Failure to pay the full amount at booking may result in order cancellation. 2.⁠ ⁠CANCELLATION & REFUND POLICY •⁠ ⁠14+ days before event: Full refund. •⁠ ⁠7-13 days before event: 50% refund. •⁠ ⁠Less than 7 days before event: No refund. •⁠ ⁠Client cannot request a refund greater than the amount paid. 3.⁠ ⁠DELIVERY & SETUP REQUIREMENTS •⁠ ⁠Client must provide parking or easy access to the setup area. •⁠ ⁠Venue should be available to us 60 mins before the event and 30 mins after the event for setup and clean up •⁠ ⁠Client must provide a table if you have ordered your photobooth with Printer and/Or Props •⁠ ⁠Area for Photobooth should be ready to set up with, if operator needs to move anything there will be an Extra $50 charge. We Require an Area that is 6ft by 10 ft to be available to us with min of 8ft high ceiling ( standard Ceilings are usually 9ft 😊 •⁠ ⁠If equipment needs to be moved more than 5 stair steps, a $50 additional fee applies. •⁠ ⁠If parking is unavailable within 50 feet of the setup area, a $50 additional fee applies. •⁠ ⁠Setup is included, but if the client requests the booth be relocated after setup, a $50 relocation fee per move will apply. •⁠ ⁠110V power outlet must be available within 20 feet of the setup area. •⁠ ⁠WiFi must be provided for instant digital sharing; if unavailable, guests will receive photos via email/text after the event. 4.⁠ ⁠TECHNICAL ISSUES & LIABILITY •⁠ ⁠We will make reasonable efforts to resolve technical issues promptly. •⁠ ⁠PhotoBoothGo is not liable for consequential damages due to technical failures. •⁠ ⁠If only partial services are provided, the rental charges will be adjusted proportionally. •⁠ ⁠Client is responsible for any damage to the photo booth caused by guests and will be billed for necessary repairs. •⁠ ⁠PhotoBoothGo is not responsible for any injuries or accidents involving the photo booth, including but not limited to: o Guests tripping over equipment, cables, or the red carpet. o The photo booth or backdrop tipping over due to guest interference. o Any other accidents resulting from improper use or negligence by guests. •⁠ ⁠Client acknowledges that they are responsible for ensuring the safety of guests around the photo booth setup. •⁠ ⁠We will make reasonable efforts to resolve technical issues promptly. •⁠ ⁠PhotoBoothGo is not liable for consequential damages due to technical failures. 5.⁠ ⁠PHOTO RIGHTS & USAGE •⁠ ⁠By using our photo booth, guests grant PhotoBoothGo permission to use event photos for marketing, promotions, and advertising. •⁠ ⁠For semi-sponsored Dates and Honey events, clients cannot opt out of photo usage. •⁠ ⁠Clients may request in writing, before the event, that images not be used for promotional purposes. 6.⁠ ⁠DISPUTE RESOLUTION, CALIFORNIA CODE, & SEVERABILITY •⁠ ⁠Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. •⁠ ⁠California Civil Code Section 1542 Waiver: The Client acknowledges and waives the provisions of California Civil Code Section 1542, which states that a general release does not extend to claims that the releasing party does not know or suspect to exist in their favor at the time of executing the release, which, if known, would have materially affected their settlement. •⁠ ⁠California Civil Code Section 1714 Waiver: The Client acknowledges that they are responsible for their own actions and those of their guests. PhotoBoothGo shall not be liable for injuries or damages resulting from misuse, negligence, or failure to adhere to provided instructions. •⁠ ⁠If any provision in these Terms is found to be unenforceable, the rest of the Terms remain valid. •⁠ ⁠These Terms supersede all prior agreements and can only be amended in writing. •⁠ ⁠Any disputes shall be resolved through binding arbitration. •⁠ ⁠If any provision in these Terms is found to be unenforceable, the rest of the Terms remain valid. •⁠ ⁠These Terms supersede all prior agreements and can only be amended in writing.
